FormI-485
Application to Register Permanent Residence
Adjustment of status is how a person already inside the United States becomes a lawful permanent resident. Filed correctly, it is the shortest road to a green card. Filed carelessly, it is the filing that puts a person in front of an immigration judge.
In plain English
Turns an approved petition into a green card without leaving the country.
Eligibility is the whole case. Before we prepare anything, we work through how you entered, every period of status since, any departures, any arrests, and any prior filings. Adjustment is available to some people and not to others, and the difference is not always obvious from the outside.
The application is filed with the medical examination, the affidavit of support, and — where they help you — the applications for work authorization and advance parole. We prepare you for the interview in the way it will actually be conducted, including the questions that follow from anything unusual in your record.
If adjustment is not available to you, we say so at the consultation, and we explain what is: consular processing, a waiver, or in some cases waiting. A firm that files an application you are not eligible for has not helped you.

§ 02 · Preparation
What you will be asked to gather.
Bring what you have to the consultation, including the documents you are unsure about. Missing items are identified there, not three months into the case.
- Passport, including every page with a stamp
- I-94 arrival record and every visa ever issued
- Approved or concurrently filed family petition
- Sponsor’s tax returns or transcripts for the most recent year
- Certified dispositions for any arrest, anywhere, however old
Where these cases go wrong.
Not hypotheticals. These are the recurring reasons a Form I-485 filing is delayed, questioned, or denied.
- 01Assuming a lawful entry when the record shows otherwise.
- 02Travelling abroad while the application is pending without advance parole.
- 03An affidavit of support that does not meet the income threshold for the household size.
- 04Failing to disclose an arrest that was dismissed or expunged. It still has to be disclosed.
§ 03Related filings
A case is rarely one form.
Most clients file two or three of these over several years. Knowing the sequence in advance is how you avoid paying twice for the same evidence.
